Florida Closing Costs — Full State-Specific Guide

Documentary Stamp Tax on the Deed (F.S. 201.02)

Florida imposes a documentary stamp tax on every deed transferring real property. The standard rate is $0.70 per $100 of consideration (purchase price). Miami-Dade County is the single exception, charging $0.60 per $100 plus a $0.45 surtax = $1.05 per $100 total.

By custom in most Florida counties, this tax is paid by the seller — it appears on the seller's side of the settlement statement. In Miami-Dade, the custom reverses and the buyer typically pays. In all cases, tax responsibility is negotiable in the purchase contract.

Documentary Stamp Tax on the Mortgage Note (F.S. 201.08)

A separate documentary stamp tax applies to the mortgage note (promissory note) at $0.35 per $100 of the loan amount. This is always paid by the borrower — it is not negotiable or transferable to the seller. On a $320,000 loan this equals $1,120. Cash purchases have no mortgage note and therefore no note doc stamps.

Intangible Tax on the Mortgage (F.S. 199.135)

Florida charges an intangible tax on secured obligations (mortgages) at $0.002 per dollar of the mortgage — 0.2% of the loan amount. This is also always paid by the borrower. On a $320,000 mortgage this equals $640.

⚠️ Note: VA loans in Florida are exempt from the intangible tax and have a reduced doc stamp rate on the note. Confirm with your title company or attorney when using VA financing in Florida.

Florida Title Insurance — OIR Promulgated Rates

Florida title insurance rates are set by the Florida Office of Insurance Regulation (OIR) — all title companies charge the same rate by law:

Purchase PriceOwner Policy RateSimultaneous Lender Policy
Up to $100,000$5.75 per $1,000$25 flat (simultaneous)
$100,001 – $1,000,000$5.00 per $1,000$25 + additional per $1,000
Over $1,000,000$4.00 per $1,000Reduced simultaneous rate

Example: On a $400,000 purchase, the owner's title premium is approximately $2,075. The simultaneous lender's policy adds approximately $225.

Florida Property Tax Rates by County

Florida property tax rates vary significantly by county and include school district levies, county levies, and special assessments. Miami-Dade and Broward counties have relatively lower millage rates but higher assessed values; rural counties may have lower values but higher millage. The statewide average effective rate is approximately 0.9% – 1.2% of market value, but urban coastal areas often run higher:

CountyEffective Tax RateAnnual Tax on $400k Home
Miami-Dade0.97%$3,880
Broward (Fort Lauderdale)1.07%$4,280
Palm Beach1.01%$4,040
Hillsborough (Tampa)1.06%$4,240
Orange (Orlando)1.12%$4,480
Pinellas (St. Pete)0.99%$3,960
Lee (Fort Myers)0.88%$3,520
Sarasota0.89%$3,560
Duval (Jacksonville)1.21%$4,840
💡 Florida Homestead Exemption: Reduces assessed value by up to $50,000 for primary residences ($25,000 applies to all levies; additional $25,000 applies to non-school levies). The Save Our Homes cap then limits annual increases in assessed value to 3% or CPI, whichever is lower. Apply with your county property appraiser's office after January 1 of the year following purchase.

Florida Homeowners Insurance — Rising Costs in 2026

Florida is experiencing a severe homeowners insurance crisis. Multiple private insurers have exited the state, leaving Citizens Property Insurance Corporation (the state insurer of last resort) as the only option for many homeowners. Average annual premiums by region:

RegionAverage Annual HO PremiumKey Risk
Miami-Dade / Broward$4,000 – $8,000+Hurricane, flood
Tampa Bay Area$3,500 – $6,000Hurricane, storm surge
Orlando / Central FL$2,500 – $4,500Wind, sinkholes
Jacksonville / NE FL$2,000 – $3,500Wind, flooding
Southwest FL (Naples/Ft Myers)$4,000 – $7,000+Hurricane (post-Ian)
Panhandle / NW FL$3,000 – $5,500Hurricane, storm surge
🚨 Flood insurance is separate: Standard Florida homeowners insurance does not cover flood damage. If your property is in a FEMA flood zone (common in coastal and low-lying areas), your lender will require a separate NFIP or private flood insurance policy — budget $800–$5,000+ annually depending on flood zone designation and coverage amount.

Frequently Asked Questions — Florida Closing Costs

What are typical closing costs in Florida?
Florida buyer closing costs range from 2% to 4% excluding down payment. Key FL-specific items: doc stamps on mortgage (0.35% of loan), intangible tax (0.2% of loan), and title insurance (buyer pays in most counties). On a $400,000 purchase with 20% down, total buyer closing costs typically run $7,000–$9,000 before prepaids.
What is Florida documentary stamp tax?
Doc stamps on the deed are $0.70 per $100 of purchase price (paid by seller by custom in most counties). Doc stamps on the mortgage note are $0.35 per $100 of the loan (always paid by buyer). Miami-Dade uses $1.05/$100 for the deed and the buyer customarily pays it there.
What is the Florida intangible tax on a mortgage?
The intangible tax is 0.002 × loan amount (0.2%). On a $320,000 mortgage it is $640. It is always paid by the borrower. VA loans are generally exempt.
Who pays title insurance in Florida?
In most Florida counties the buyer pays for the owner title policy. Exceptions include Miami-Dade, Broward, Sarasota, and Collier counties where the seller customarily pays. The lender title policy is always paid by the buyer. Florida title rates are state-regulated and the same at all companies.
Is flood insurance required in Florida?
Your lender requires it if the property is in a FEMA Special Flood Hazard Area (SFHA). Even outside mandatory flood zones, purchasing coverage is strongly recommended in Florida given storm surge and heavy rainfall risk. Flood insurance is separate from homeowners insurance and must be purchased from the NFIP or a private flood carrier.
What is the Florida homestead exemption?
The homestead exemption reduces a primary residence assessed value by up to $50,000. The Save Our Homes cap then limits annual assessment increases to 3% or CPI (whichever is lower). Apply with your county property appraiser the year after purchase. This can significantly reduce your property tax bill from year two onward.
How does Miami-Dade differ from other Florida counties at closing?
Miami-Dade has the highest doc stamp rate ($1.05/$100 vs $0.70) and by local custom the buyer pays it instead of the seller. Miami-Dade also has some of the highest homeowners insurance costs nationally due to hurricane exposure. Title insurance in Miami-Dade is paid by the seller by custom.
Can the seller pay my closing costs in Florida?
Yes. Sellers can contribute toward buyer closing costs within limits set by the loan type: 3%–9% for conventional (varies by down payment), 6% for FHA, 4% for VA. Seller concessions are negotiated in the purchase contract and reduce your out-of-pocket cash at closing.
